Terms and Conditions of Service

Welcome to Brainmark Health Inc. (“Brainmark”, “we”, “us”, or “our”). These Terms and Conditions (“Agreement”) govern your access to and use of our services, including EEG-based assessments, neurofeedback treatment, clinical and counselling psychology consultations, and related programs (collectively, the “Services”).
Please read these Terms carefully. By using our Services, you agree to be bound by these Terms. If you do not agree, you may not access or use our Services.
1. Eligibility and Consent
You must be at least 18 years old or have the consent of a legal guardian to use our Services. By using our Services, you confirm that:
You are legally capable of entering into binding contracts;
All information you provide to us is truthful, complete, and up-to-date;
You provide informed consent to undergo assessments, neurofeedback training, and/or psychological services.
2. Nature of Services
Brainmark provides:
EEG-based cognitive and emotional assessments for predictive mental health evaluation;
Neurofeedback therapy for mental and neurological optimization;
Clinical and Counselling Psychology services provided by licensed professionals.
These services are intended for wellness, performance, and mental health support and do not replace emergency psychiatric or medical treatment.
3. Health Disclaimer
You acknowledge and agree:
Our services are not a substitute for diagnosis or treatment by a psychiatrist, neurologist, or medical doctor;
We do not prescribe medication;
You should consult your physician or mental health provider before beginning any neurofeedback or psychological treatment if you have concerns about your health condition.
If you are in crisis or experiencing suicidal thoughts, please contact emergency services or a crisis hotline immediately.
4. Privacy and Confidentiality
Your data is handled in accordance with our Privacy Policy . We comply with applicable data protection laws.
All personal and health information is kept confidential and stored securely.
Brainmark may use anonymized data for research, quality improvement, or statistical purposes.
You may request access to or correction of your records in accordance with applicable laws.
5. Payment and Cancellation
Payment is due prior to or at the time of service unless otherwise agreed.
Appointments canceled with less than 24 hours’ notice may be subject to a cancellation fee.
Package purchases (e.g., multiple neurofeedback sessions) are non-refundable once services have begun, unless a medical issue prevents continuation.
6. Risks and Limitations
While neurofeedback and psychological therapy have demonstrated benefits, you acknowledge:
Individual results may vary;
Temporary discomfort, fatigue, or emotional discomfort may occur during or after sessions;
Neurofeedback and psychological services may not be effective for all individuals or conditions.
You accept full responsibility for the decision to participate in any of our Services.
7. Limitation of Liability
To the maximum extent permitted by law:
Brainmark and its practitioners shall not be liable for any indirect, incidental, special, or consequential damages arising out of the use or inability to use our Services;
Our total liability for any claim related to the Services is limited to the amount paid by you in the past 12 months.
8. Intellectual Property
All content, assessments, methods, software, and materials used or provided by Brainmark are the exclusive property of Brainmark Health Inc. and may not be reproduced, copied, or distributed without written permission.
9. Termination of Services
We reserve the right to terminate services or refuse access to any user who:
Violates these Terms;
Demonstrates behavior that is threatening, unsafe, or abusive;
Is deemed unsuitable for neurofeedback or psychological treatment by our professional staff.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of the jurisdiction in which Brainmark Health Inc. is incorporated, without regard to its conflict of law principles.
Any disputes will be resolved in the competent courts of the Province of British Columbia, Canada
11. Amendments
Brainmark reserves the right to update or change these Terms at any time. Updated versions will be posted on our website and will take effect immediately unless stated otherwise. Continued use of the Services constitutes acceptance of any revised terms.
